These Terms & Conditions govern the use of the www.orga.my website (the “Website”) and any transactions made through it. By placing an order with Orga Mountainworks, you acknowledge and agree to these Terms & Conditions. Please read them carefully.

 

1. Company Information

In these Terms & Conditions, “Orga Mountainworks,” “Orga,” “we,” “our,” or “us” refers to Orga Mountainworks, a sole proprietorship registered in Malacca, Malaysia, under the Registration of Businesses Act 1956 (ROBA 1956) and ROBA Rules 1957.

 

2. Applicability

2.1 These Terms & Conditions apply to all offers, orders, and sales of products through the Website.

2.2 We reserve the right to modify these terms at any time. It is your responsibility to review them prior to each purchase.

 

3. Pre-Order Process

3.1 Products available for pre-order will be listed on the Website with stated prices.

3.2 By placing a pre-order, you confirm that you:

    3.2.1 Provide accurate contact and payment information.

    3.2.2 Provide a valid delivery address.

    3.2.3 Are the authorized owner of the payment method used.

3.3 An order is considered placed when payment is successfully made through the product page.

3.4 Before confirming your order, you will have the opportunity to review the order details, total cost, and agree to these Terms.

3.5 All orders submitted are considered offers from you. We reserves the right to accept or reject any order at our discretion.

4. Contract Formation

4.1 Once payment is received, you will be issued a Sales Invoice in email.

4.2 A binding contract is formed only upon We receipt of payment.

4.3 We do not store a copy of your contract. Please download or print your Sales Invoice and a copy of these Terms for your records.

5. Prices

5.1 The applicable product price is the one listed at the time your order is placed.

5.2 Prices include any applicable government taxes (e.g., SST/GST).

5.3 Delivery charges are calculated based on courier rates and added to the final amount during checkout.

6. Errors & Inaccuracies

6.1 In rare cases, product descriptions or prices may be incorrect. If an error affects your order, we will notify you and cancel the order. You may reorder once the error has been corrected.

 

7. Non-Delivery & Termination

7.1 If We are unable to deliver a product due to circumstances beyond our control (e.g., lost shipment), we reserve the right to cancel the contract. You will be notified and offered a replacement or refund.

8. Product Details & Usage

8.1 Product descriptions and specifications are listed on the Website. Colors may vary due to screen differences.

8.2 Please read the product care instructions on the Website before purchase. For any questions, contact us prior to ordering.

8.3 Products must be used for their intended purpose. Misuse may lead to product damage or user harm, and voids any warranty or liability.

8.4 Proper care and maintenance are critical to the product’s longevity and performance. Follow all care guidelines provided.

8.5 Incorrect washing or use of improper detergents may cause irreversible damage, including tears, fading, or loss of functionality.

8.6 Even with proper care, color fading over time is normal due to exposure to sunlight and environmental conditions.

9. Payment Methods

9.1 We accept the following payment options:

9.1.1 FPX (for Malaysian residents)

9.1.2 Atome (3-month installment)

9.1.3 PayPal (for international orders)

10. Delivery (Ready Stock)

10.1 Orders of ready stock items will be shipped within 3 working days of confirmation.

10.2 If not delivered within 7 days, you may cancel the order and request a refund.

10.3 Orders will be delivered to the shipping address provided in the Sales Invoice.

11. Delivery (Pre-Order)

11.1 Pre-ordered products will be delivered within 60 days from the order confirmation date.

11.2 If not delivered within 60 days, you may cancel the order and request a refund.

11.3 Orders will be delivered to the address listed in the Sales Invoice.

12. Cancellation & Returns

12.1 If you need to exchange a product due to incorrect size, contact us. We will replace it if your requested size is available. Otherwise, you may received a refund.

12.2 For defective items, contact us immediately. Replacements will be made based on available stock.

13. Liability

13.1 We are not liable for damage caused by improper use, care, or maintenance of the product.

13.2 We are not responsible for indirect or consequential losses, including lost revenue or business.

13.3 Nothing in these terms excludes our liability for personal injury or death resulting from our negligence.

14.1 Any personal data collected during the order process is subject to our Privacy Policy. Please review it to understand how your data is handled.

15. Governing Law

15.1 These Terms & Conditions and any disputes arising from them are governed by the laws of Malaysia.
